Norway’s PKI, data privacy and electronic signature regulations and laws as of 2023:
- EU General Data Protection Regulation (GDPR) – GDPR is the primary data privacy regulation in the European Union (EU). It applies to all businesses processing the personal data of EU residents, regardless of the business’s location.
- Personal Data Act (Personopplysningsloven) – This law complements the GDPR by further governing the processing of personal data within Norway. It emphasizes transparency, consent, and data minimisation principles.
- eIDAS Regulation (EU 910/2014) – eIDAS recognises three levels of electronic signatures:
- Basic electronic signature (BES) – Simplest electronic signature, often and image scanned from a handwritten signature.
- Advanced electronic signature (AES) – Offers additional security with data encryption and signer verification.
- Qualified electronic signature (QES) – Highest level of security with independent verification provided by a trust service provider (TSP).
- Electronic Signatures Act (Lov om elektroniske signaturer) (LOV-2018-06-15-44) – This act establishes the legal framework for eSignatures and grants them the same weight as handwritten signatures in most cases.
- Civil Disputes Act (Tvisteloven) (LOV-2017-06-16-63) – Section 19-5 of this act recognised electronic documents as evidence in court proceedings, including electronically signed documents.
- Financial Contracts Act (Avtaleloven) (Lov av 30. April 1917 nr. 3) – Section 5 of this act clarifies that electronic signatures can be sued for suretyship agreements (guarantee contracts).
- Land Registration Act (Lov om tinglysning) (Lov av 26. Juni 1986 nr. 50) – Section 8-5 of this act requires QES for documents related to real estate transactions.
- Public Procurement Act (Lov om offentlige anskaffelser) (Lov av 17. Juni 2016 nr. 89) – Section 15 of this act mandates electronic submission of tenders. Section 15-3 allows contracting authorities to require specific signature standards, which is often AES.
