Electronic and digital signature laws and regulations in Singapore

Singapore has a comprehensive legal framework for electronic signatures, digital signatures, and PKI. The main legislation governing electronic signatures is the Electronic Signatures Act (ETA) Cap 88. The ETA defines electronic signatures and establishes a presumption of their validity in certain circumstances.

Singapore’s PKI, data privacy and electronic signature regulations and laws as of 2023:

  • Electronic Signatures Act (ETA) Cap 88 – The ETA regulates the use of electronic and secure electronic signatures in Singapore – though both are legally binding. It defines the following:
    • Electronic signatures – Electronic signatures are any electronic means to identify and authenticate a person and to indicate that the person approves of the information contained in the record.
    • Secure electronic signatures – Secure electronic signatures are electronic signatures that meet additional security requirements, such as being based on a cryptographic algorithm and being linked to the electronic record. This ensures the authenticity and integrity of the record.

    The ETA states that secure electronic signatures are presumed to be valid and have the same legal effect as handwritten signatures.

  • Electronic Transactions (Certification Authority) Regulations 2010 – Regulates the operation of certification authorities (CAs), which are organisations that issue and manage digital certificates. Digital certificates are electronic documents that bind a public key to a specific entity. CAs must be accredited by the Infocomm Media Development Authority (IMDA) to operate in Singapore.
  • Personal Data Protection Act 2012 (PDPA) – The primary law governing data privacy in Singapore is the PDPA. It sets out a comprehensive framework for the collection, use, disclosure and retention of personal data. It establishes the data protection principles that all organisations in the country must adhere to.
