Providing PKI, digital trust, and electronic signatures fully integrated with Denmark’s MitID

PKI, digital trust, and e-signatures in Denmark

Denmark is a digital frontrunner in the EU, recognised for its advanced adoption of electronic identity (eID) systems and its strong commitment to digital transformation. At the heart of this evolution is MitID, Denmark’s national electronic ID system, which plays a key role in identity verification and facilitating secure access to public and private digital services.

Aligning with the eIDAS Regulation, Denmark recognises electronic signatures and trust services as legally valid and enforceable across borders. This provides a stable and reliable framework for businesses and public institutions to adopt fully digital processes, including signing contracts, onboarding clients and executing official transactions.

As a global leader in high-trust e-security solutions, Ascertia has been an integral part of Denmark’s digital trust journey. We support organisations across multiple industries adopt digital technologies, such as:

Electronic and digital signature laws and regulations in Denmark

Denmark’s approach to electronic signatures is grounded in the EU-wide eIDAS Regulation, which defines the legal status of electronic trust services and identity verification.

Ascertia’s products and services comply with all relevant Danish and EU laws concerning these technologies, so you can rest assured your business is compliant and your data is safe.

Denmark’s PKI, data privacy, and electronic signature regulations and laws:

  • eIDAS Regulation (EU No. 910/2014): Establishes a standardised framework for electronic identification and trust services.
  • Danish Act on Supplementing Provisions to the eIDAS Regulation: This national act implements and enforces the provisions of the eIDAS Regulation within Denmark, aligning EU Directives with Danish law.
  • Danish Contracts Act (Aftaleloven): This act governs the formation and validity of contracts in Denmark, affirming that agreements concluded electronically are legally valid.
  • Danish Act on Electronic Signatures: Although largely superseded by the eIDAS Regulation, this act provides additional context and fills gaps not directly addressed by EU law, supporting the legal use of e-signatures in Denmark.
  • MitID and NemLog-in infrastructure: MitID replaces NemID as Denmark’s national electronic identification system. Digital signatures are executed within the NemLog-in infrastructure, managed by the Danish Agency for Digitalisation (Digitaliseringsstyrelsen).
  • Public Certificates for Electronic Services (OCES) Standard: A national framework for issuing digital certificates used in electronic services, ensuring secure and authenticated digital communication.
  • National Standard for the Security Level of Identities (NSIS): Implements the security levels described in Article 8 of the eIDAS Regulation, defining identity assurance for secure digital transactions.
  • General Data Protection Regulation (GDPR): EU regulation, governing the processing of personal data, ensuring privacy and protection for individuals. It applies directly in Denmark, setting out principles for data handling, consent, and individuals’ rights.
  • Danish Data Protection Act: This act supplements the GDPR, providing specific provisions for data processing in Denmark, including data processing regulations and enforcement responsibilities of Datatilsynet.
  • Data Sovereignty Provisions: Under the Danish Data Protection Act, certain data processing activities may be required to occur within Denmark’s borders to ensure compliance with national security and privacy standards.
